§ 1 Area of application

These Terms and Conditions regulate the contractual relationship between you as a natural person and us, IC Music And Apparel GmbH and are valid only for business relations with consumers for the purposes of §13 Civil Code. The consumer according to this regulation is every natural person who closes a legal deal for a purpose, which can be added neither commercial or an independent professional activity. The Terms and Conditions are valid for the offers on the Domain https://www.impericon.com and our printed catalogues. We complete your order based on our Terms and Conditions that are valid at the time of placing the order. Our Terms and Conditions are available in our printed catalogues sent by us and are available to you on our Internet site https://www.impericon.com .

§ 3 Conclusion of contract

You can order on the Internet from us via our homepage https://www.impericon.com .

The representation of the products show neither in our online shop nor in our printed catalogues an obliging offer for the purposes of §145 Civil Code.

In the Shopping Cart you have the possibility to initiate the order process using the button “Proceed to Checkout”. After entering your personal data you will find a summary of your order at the final step of the order process. There you can take a look at your order again and have the option to make changes if necessary. By using the button “Confirm Order” you place a binding offer regarding the chosen items. We are authorised to accept your offer within 14 days by sending an acknowledgement of order (via mail or post). Your order is not deemed to be accepted until we have accepted it by acknowledgement. Should we not accept your offer within 14 days it is deemed to be disclaimed. Products which are not listed in the acknowledgement are not part of the act of sale.

§ 4 Delivery

We deliver products in stock within 5 working days by DHL to the address given by you. Dispatch beyond the Federal Republic of Germany and within Europe the delivery, provided the product is available, can take approx. 10-14 working days. When shipping to the non-European foreign countries the delivery time is dependent on the dispatch type and the receiver’s country. All delivery times or delivery periods are non-binding, they are based on an agreement. The preceding information about prospective dates of delivery or delivery timescales is non-binding, unless it has been expressly agreed between the consumer and us. In the case of an expressly agreed date of delivery if there is a delay in delivering the order you must allow us an extension of up to 2 weeks. If we are unable to deliver within the timeframe given you are entitled to withdraw from the sale agreement. Should an article not be available for delivery within the given timeframe, we will inform you as quickly as possible of the date of delivery, or alternatively that the delivery cannot occur.

If a package has been sent by us but has not yet been delivered to you, please contact us within 45 days of the last tracking update so that we can initiate an investigation. After this time, a refund or a possible new shipment can no longer be guaranteed.

§ 5 Cancellation Policy

You have the right to cancel this contract within 14 days without providing any reason. The cancellation period begins on the day you, or a third party designated by you who is not the carrier, take possession of the goods (your order). To exercise your right of cancellation, you must inform us (IC Music and Apparel GmbH, Deutscher Platz 4, 04103 Leipzig | Germany, Email: shop.de@impericon.com) before returning the goods, of your decision to cancel this contract. You can use the contact form for this purpose, although it is not mandatory. To meet the cancellation deadline, it is sufficient to send the notification about exercising your cancellation right before the cancellation period expires.

A right of cancellation does not exist for distance contracts:

For the delivery of goods that are custom-made according to customer specifications or clearly tailored to personal needs, or which are unsuitable for return due to their nature, are perishable, or have exceeded their expiration date.
For the delivery of audio or video recordings or software, if the delivered media has been unsealed by the consumer.
For the delivery of piercings (e.g., plugs, tunnels) if their seal has been opened.
For the delivery of tickets and ticket bundles (e.g., ticket and T-shirt packages).

Consequences of Cancellation

If you cancel this contract, we will refund all payments received from you, including delivery costs (except for additional costs arising if you chose a delivery method other than the standard, least expensive option we offer), promptly and no later than 14 days from the day we receive notification of your cancellation (as per § 357 Abs. 2 BGB). Refunds will be made using the same payment method you used for the transaction unless expressly agreed otherwise. No fees will be charged for the refund.

We may withhold the refund until we have received the goods back or you have provided proof of return shipment, whichever is earlier.

You must return or hand over the goods promptly and no later than 14 days from the day you inform us of the cancellation of this contract. The deadline is met if you send the goods before the 14-day period expires. If a free item was included with the purchase, it must also be returned unused; otherwise, the official retail price of the free item will be charged. You are only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics, and functioning.

Extended Cancellation Policy – 30 Days After Receipt

We offer a voluntary extended return policy beyond the statutory cancellation right, allowing you to cancel the contract up to 30 days after receiving the goods. To exercise this right, you must inform us (IC Music and Apparel GmbH, Deutscher Platz 4, 04103 Leipzig | Germany, Email: shop.de@impericon.com) of your decision to cancel this contract before returning the goods. You can use the sample cancellation form, although it is not mandatory. The deadline is met if you send the goods before the 30-day period expires. This extended return right only applies if the goods have been worn solely for fitting purposes and are returned in their original condition.

The extended return right does not apply to contracts:

For the delivery of goods that are custom-made according to customer specifications or clearly tailored to personal needs, or which are unsuitable for return due to their nature, are perishable, or have exceeded their expiration date.
For the delivery of audio or video recordings or software, if the delivered media has been unsealed by the consumer.
For the delivery of piercings (e.g., plugs, tunnels) if their seal has been opened.
For the delivery of tickets and ticket bundles (e.g., ticket and T-shirt packages).

For more information please read our shipping and returns section on the website. Please, use for the return dispatch of the product the packaging material which came from us, or pack the articles in such a way that they arrive in good condition with us. With the return of shoes please use another bag or box and not the shoe cardboard box as the sole outside packaging as the resale of a shoe with damaged box is not possible. In addition, we ask you not to remove the original tags and for hygienic reasons with underwear and laundry not to remove any protective coverings. Also with nonobservance of the requests your right of return continues without limitation. Also pay particular attention to the completeness of your bank information. We are not held liable for any financial problems originating from you providing incorrect details.

§ 7 Pricing

All shown prices are totals including the VAT. Postal and forwarding charges are added after the list in sec. 7.

§ 8.1. Priority Handling

Your order will be processed and shipped with priority by us (IC Music and Apparel GmbH). This means that your shipment will be handed over to the shipping service provider on the same day or, at the latest, the following day. The service does not affect the duration of the subsequent delivery by the shipping service provider. You will receive a link to track your shipment once it has been sent. The respective fee applies when selecting the Priority option. No shipping takes place on weekends or public holidays.

Please note that this service cannot be considered for a refund in the event of a return.

§ 8.2. GoGreen

If you choose climate-neutral shipping for your order, you are making a sustainable and valuable contribution to climate protection. The additional costs cover the offsetting of the CO2 emissions from your package shipment.

§ 9 Payment

We accept payment via prepayment, PayPal, credit card, Klarna, Apple Pay, Google Pay, eps transfer, iDEAL, and Bancontact. There may be different options depending on the delivery country and device. Due to technical reasons, the use of accumulated credit for online orders is unfortunately not yet possible.

§ 10 Warranty

The statutory warranty rights apply. For complaints, we kindly ask for proof of the purchase date by providing a copy of the invoice, which should be sent together with the item to be complained about to the following address:

Normal wear and tear or usage of the goods do not constitute a valid warranty claim.

§ 11 Ticket Sales

Concert tickets, hereinafter referred to as tickets, are sold only to end customers. When purchasing tickets, you are responsible for ensuring that the details, such as the date, price, time, and venue, are correct. IC Music and Apparel GmbH (https://www.impericon.com) does not guarantee the accuracy of the event information provided on our website. Unforeseeable circumstances or force majeure do not entitle you to compensation claims. Furthermore, we are not obligated to notify you of last-minute changes (e.g., due to an artist's illness). You are responsible for staying informed. Reservation of specific seats is usually not possible. Please note that tickets cannot be purchased via PayPal and are excluded from free shipping.

The ticket prices we list include the current statutory VAT as well as a presale and booking fee, which may differ from the printed ticket price. Errors and printing mistakes are reserved. The tickets remain the property of IC Music and Apparel GmbH until full payment is received.

Tickets ordered are generally non-returnable, non-cancellable, or non-exchangeable. Exceptions only apply in cases of wrong delivery, cancellation, or rescheduling of a concert. Additionally, all products sold in combination with tickets (e.g., ticket and T-shirt bundles) are also excluded from exchange or return, unless there was an incorrect delivery or the item was damaged. In such cases, we will replace the item immediately. In the case of cancellation or rescheduling of an event, you can return your ticket within 14 working days of the originally scheduled event date; after this period, any claim for a refund expires. If tickets are returned due to a concert's cancellation or rescheduling, the nominal value of the ticket (printed price) will be refunded. If the event is rescheduled, the tickets remain valid. There is no entitlement to attend a specific venue. In the case of a rescheduled date, tickets may be returned.

Audio, film, and video recordings, even for private use, are generally prohibited depending on the event organizer. Any misuse will be prosecuted under criminal law. If image and/or sound recordings (e.g., radio or TV broadcasts) are made during the event by authorized personnel, you agree that you may be captured in image and/or sound and that these recordings may be reproduced, distributed, or publicly broadcasted (including via transmission) without compensation, provided that no legitimate interests of yours are opposed. Tickets may only be purchased for private use. The commercial or business resale of a ticket without the organizer’s consent (particularly selling to third parties for profit or auctioning it through an online platform) is prohibited.

§ 12 Care Instructions

Please follow the washing instructions found on the labels of the items. We are not responsible for any damage caused by incorrect cleaning.

§ 13 Retention of Title

The goods delivered remain the property of IC Music and Apparel GmbH until full payment has been received.

§ 14 Data Storage

We strictly adhere to data protection regulations. By placing an order, you consent to the storage, processing, and use of the personal data you provide in accordance with the Federal Data Protection Act (BDSG) for the processing of your order. Your stored personal data will only be forwarded to the responsible shipping company for the dispatch of your goods. All personal data will be treated confidentially. For marketing purposes, we exchange data with other mail-order and service companies. If you have consented, your personal data may be forwarded to these mail-order and service companies. Your legitimate interests will be considered.

§ 15 Right of Objection under the Federal Data Protection Act (BDSG)

Under the BDSG, you have the right to object to the use or transfer of your data for advertising purposes (blocking notice). Additionally, you have the right to request information, and under certain conditions, to request the correction, blocking, or deletion of your data stored in our files. Further information or clarification on data protection can be provided by the data protection officer of IC Music and Apparel GmbH, who can be contacted at Deutscher Platz 4, 04103 Leipzig | Germany or by email (datenschutz@impericon.com). This person is also your contact if you wish to exercise your right to object under the BDSG.

§ 16 Limitation of Liability

For damages other than those resulting from injury to life, body, and health, IC Music and Apparel GmbH is only liable if these damages are caused by intentional or grossly negligent actions, or by a breach of a significant contractual obligation by IC Music and Apparel GmbH or its agents. A significant contractual obligation is an obligation whose fulfillment is essential for the proper execution of the contract and on which the buyer is regularly entitled to rely. Any further liability for damages is excluded. Claims arising from a guarantee provided by IC Music and Apparel GmbH regarding the quality of the goods and from the Product Liability Act remain unaffected. According to the current state of technology, data communication over the Internet cannot be guaranteed to be error-free and/or continuously available. Therefore, we are not liable for the continuous availability of our online store.

§ 17 Applicable Law

German law applies to all disputes arising from or related to this agreement, excluding the UN Sales Convention.

§ 18 Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR platform) which can be accessed at: http://ec.europa.eu/odr

We aim to resolve any disputes from a contractual relationship amicably. We are not obligated to participate in a dispute resolution procedure and cannot offer participation in such a procedure.

§ 19 Severability Clause

Should any provision of these General Terms and Conditions be invalid, the validity of the remaining provisions shall not be affected.
